TERMS OF SERVICE
READ CAREFULLY

I agree to the following:

1. A valid credit or debit card will be needed to reserve your event. A nonrefundable $100.00 deposit is required at the time of booking to reserve your date and time of the event. The remaining balance is due 24 hours prior to the start of your event. If paying with a credit card on the day of you will be subject to a 7% fee for processing. If you need to reschedule we will make one attempt to reschedule your event to another date based on availability. After the one attempt, we may have to assess additional fees.

2. I recognize that there are certain significant risks associated with the interactive entertainment activities organized by Gaming Paradise. These risks include but are not limited to, serious bodily injuries and/or psychological harm caused by involvement in a stressful environment that may require some physical exertion. I understand that Mature and Teen rated titles may be played during the experience and that my child/children may be exposed to this content. I am fully responsible for making all parties (essentially including, but not limited to the host parent and Gaming Paradise personnel) aware of any special needs or allergies my child/children may have. The risk of serious injury from participating in Gaming Paradise activities, although minimal, does exist as it does in all play and amusement activities. I agree to assume full responsibility for any personal injury I may sustain in connection with participation in interactive entertainment activities organized by Gaming Paradise, and I release and discharge Gaming Paradise and its owners, employees, representatives, and agents from any liability for any injuries I may sustain, including injuries caused by the negligence of Gaming Paradise or its employees, representatives, or agents.

3. I agree to indemnify and defend Gaming Paradise and its owner, employees, representative, and agents against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs and expenses, which may in any way arise out of my participation in interactive entertainment activities organized by Gaming Paradise, including injuries caused by the negligence of Gaming Paradise or its employees, representatives, or agents.

4. I agree to pay for all damages to the facilities of Gaming Paradise caused by my negligent, reckless, or willful conduct. This includes any damages resulting from wet clothes, toys, or party favors.

5. Any legal or equitable claim that may arise from my participation in interactive entertainment activities organized by Gaming Paradise shall be resolved under Virginia law with exclusive jurisdiction and venue being in the state and federal courts of the State of Virginia.

6. I agree and acknowledge that I am under no pressure or duress to sign this Release and that I have been given a reasonable opportunity to review it before signing.

7. While your party is in effect the Game Coach will be taking pictures of the party from inside and outside of the trailer. You will then be able to view these pictures on Gaming Paradise's Facebook, Instagram, and Website platforms, as well as copy them to your files. If you do not want our Game Coach taking these pictures or posting them on social media and/or our webpage please notify us via email prior to the party. This is a service we provide to our guests so they can be sure to capture their party as it happens.

8. Gaming Paradise LLC or any of its employees will not be responsible for any damage to property resulting from a request by the client to position the gaming trailer in a specific location. This includes both above-ground and below-ground property/equipment damage. Additionally, Gaming Paradise reserves the right to charge the client’s credit card for damages and/or theft to the gaming trailer, equipment, and/or property resulting from the careless and/or willful damage of same by clients and guests. All liability for damages or injuries is the sole responsibility of the client and/or host.

9. The invalidity or unenforceability of any provision of this Release, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or
enforceability of any other provision of this Release or any other application of such provision, as the case may be.

10. Any controversy or claim arising out of or relating to this Release, or the breach thereof, shall be settled by arbitration administered by a single arbitration appointed by the American Arbitration Association by its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in the state or federal courts of the State of Virginia or a court that has jurisdiction to enter it.
I acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants but are also present for volunteers.

11. Gaming Paradise reserves the right to terminate the party without refunding the remaining balance.

12. I will ensure that all of my guests are not carrying any concealed weapons. Failure to do so will result in the termination of the party.

WEATHER
Our trailer was designed for all types of weather conditions. The theater is insulated and climate-controlled with heat and air conditioning. There may be occasions when the weather does not want to cooperate with your scheduled party. In the event of severe weather (lightning, very high winds, flooding, and/or extremely heavy rains, snow, or ice) we may (and reserve the right to) reschedule your service to guarantee the safety of you, your guests, our staff and equipment. If the threat of these storms threatens your party and you are aware in advance (pending or anticipated snowstorm or other strong weather events) please contact us to begin the rescheduling.

ALCOHOL/DRUGS:
You may serve alcohol at your event or party; however, we reserve the right to refuse, cancel or cut short any party or booking when alcohol is being served. Drugs of any sort will not be tolerated in or around the Game Truck equipment. Any observed use of illegal narcotics or legal narcotics used in an illegal manner will result in the termination of the party immediately.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law
